Recall of More Contaminated Drugs from a MA Compounding Pharmacy

Last fall’s recall of drugs from Massachusetts compounding pharmacy NECC kick-started a strong focus on the safety of drugs from lightly regulated U.S. compounding pharmacies. NECC had distributed a pain medication that turned out to be contaminated with a fungus. Our Pearland drug injury lawyers note that the NECC drug contamination led to fatal complications from fungal meningitis in 50 patients as well as to ongoing medical problems in more than 700 other patients.

Now another Massachusetts compounding pharmacy, Pallimed Solutions, has issued a voluntary recall on 16 of its “sterile” injectable drugs after a surprise inspection of its facility found visible particulates (potential contaminants) in some of its drugs.

Pallimed Solutions Recall Extends to 16 Medications

The recalled Pallimed drugs include injectables like atropine, testosterone cypionate, and other erectile dysfunction drugs. Pallimed has voluntarily stopped all sterile compounding operations. And the company emphasizes that as yet no injuries or illnesses have been reported because of the problem. (Source: CNN.com, 3/26/13)

Our Pearland drug injury lawyers point out that the surprise inspection at Pallimed that led to the recall is just part of the wave of renewed concern over the safety of drugs from compounding pharmacies. Massachusetts, home of NECC, has been stepping up surprise inspections of compounding facilities within its borders.

And the U.S. FDA has also stepped up oversight of compounding pharmacies. In fact, there’s been a recent flurry of drug recall activity due to contaminated medications. Let’s hope that the additional focus on compounding pharmacy activities represents a true safety initiative that will protect us all from contaminated drugs and needless injury.

Houston Texas School Bus Accidents and Your Child’s Safety

If you have a child in school who takes a school bus back and forth to class, you may be aware of the ongoing controversy about school bus driver pay and school bus safety standards. Safety advocates maintain that the relatively low pay offered to school bus drivers could result in a lower quality of driver and a lower standard of care regarding your child’s safety. But school bus transportation officials maintain that the weak economy has allowed employers more choice in selecting school bus drivers and that the quality of drivers has risen in recent years.

Our Houston school bus accident attorneys point out that school bus collisions aren’t necessarily caused by bus drivers that drink, do drugs, or smoke. The majority of the school bus injury accidents that we see are caused by the negligent acts of other drivers. For instance, last year, there was a tragic and fatal school bus accident near Temple, Texas that was caused by the driver of a Lowe’s truck.

HISD School Bus Rear-Ended by Passenger Vehicle on Friday, Resulting in Student Injuries

And on Friday morning on Rosehaven near Reed in south Houston, an SUV, a car, and an H.I.S.D. school bus were involved in a multi-injury collision. About 18 people were on the school bus at the time of the crash, and at least four of the students were hospitalized with injuries from the collision. The H.I.S.D. school bus was carrying students from the Pro-Vision School when the driver of another vehicle rear-ended the bus. (Source: Dale Lezon, Houston Chronicle, 3/22/13)

What actually caused the driver of the passenger vehicle to rear-end the bus was not stated. The Houston school bus accident attorneys at Denena Points, PC mention that driver distraction and driver fatigue are two frequent causes of rear-end wrecks, but equipment failure and impaired driving are among the other factors that might cause a rear-end wreck.

School Buses Remain One of the Most Statistically Safe Forms of Transportation

Our Houston school bus accident attorneys point out that about half a million school bus drivers take to the roads every day. Their buses carry millions of children to and from school each day. Yet as the National Association of State Directors of Pupil Transportation Services carefully notes, school buses remain the safest mode of transportation for children going to and from school.

According to the U.S. NHTSA, between 2000 and March of 2011, only 0.34% of all fatal motor vehicle accidents involved a school bus or a school van. The NHTSA statistics also reveal that even when school bus accidents do occur, the occupants of the bus are less likely to receive injuries than the occupants of the other vehicles involved in the accidents. In other words, it is far safer for your child to take a school bus to classes than to walk, ride a bike, skateboard, or even ride in your passenger vehicle.

How Vicarious Employer Liability could help You after a Truck Injury

Dollar_sign_(reflective_metallic)After a truck accident, the company that insures the commercial truck could face massive costs form the injuries and ongoing medical care you might require. So the bottom line-conscious insurer will want to do all it can to put the blame for the accident back on you and minimize the value of your claim, or even avoid liability altogether.

The insurance adjuster might badger you relentlessly in order to try and obtain statements from you that could be used against you as admissions of your own fault. Our Galveston truck accident attorneys caution that the insurance adjuster might also offer you a quick cash settlement. Facing the heavy financial burdens caused by the commercial truck wreck, the settlement might look good to you, but it likely only offers a small fraction of the costs you will face over time from your injuries.

The financial expenses from a commercial truck accident injury can be astronomical to the victim. And the average truck driver is not going to have the assets to cover your costs. Our Galveston truck accident attorneys emphasize that you need to rely on the high dollar value of his truck insurance policy. And where the truck driver is the employee of another entity, you could look to the doctrine of “respondeat superior,” or vicarious employer liability, to help you as well.

Vicarious liability just means that an employer is liable for the negligent actions of his employees while they are on the job (like when they are driving trucks on his behalf). The employer’s assets and insurance policy might be far larger than the truck driver’s. And they could help pay the massive costs of the injuries that a collision with a heavy commercial truck has caused.

Give Your Young Texans the Safety Advantage in Your Vehicle: Buckle Up

Seatbelts are one of the most critical features in your vehicle for ensuring the safety of yourself and your children. Seatbelts help restrain drivers and passengers from being ejected from their vehicles in the event of a crash. Statistics show that around 75% of occupants ejected from a vehicle during a wreck suffer fatal injuries.

Modern vehicles are designed with airbags, cushioned seats, and crumple zones to help protect you from the forces of impact in a violent crash. But our Angleton, TX personal injury lawyers point out that if you or your children are not wearing your seatbelts; you lose the benefit of those modern safety features. And you risk severe head injuries and internal traumas when you’re thrown from your vehicle to go crashing against the ground or another vehicle.

Young Boy Dies after being Ejected from Vehicle in Harris County Collision

For example, on Tuesday morning in east Harris County, a 10-year-old boy lost his life in a tragic collision when he was ejected from a Pontiac during the wreck. He was not wearing a seatbelt restraint at the time of the accident. The crash reportedly occurred when the woman driving the Pontiac ran a red light and hit a Toyota Scion. The driver and the other child in the Pontiac, who were both buckled in, survived the wreck. (Source: Dale Lezon, Houston Chronicle, 3/19/13)

Our Angleton, TX personal injury lawyers emphasize that more than 63% of the victims who died in 2010 motor vehicle crashes were not wearing their seatbelts when their accidents occurred. Make buckling up a routine part of any journey for you and your children. Your seatbelts could save your lives.

Some Sobering Facts about Texas Wrong-Way Driving Accidents

A study by the U.S. NTSB, Highway Special Investigation Report, Wrong-Way Driving (2012), reveals that while only about 3% of all vehicle collisions are due to wrong-way driving, these crashes are much more likely than other types to cause truly severe or fatal injuries. This is because many of them occur at high speeds as head-on collisions. Our East Texas highway collision attorneys point out that a high proportion of these crashes are like this one in East Texas, and occur on two-lane highways.

Studies focusing on head-on collisions have found that the fatality rate is between 12% and 27% higher than for other types of crashes. About 60% of the fatal wrong-way crashes result from drunken driving. Distracted driving and driver fatigue are two of the other leading causes of these catastrophic head-on collisions. What You Should Know about Fault in Bay City TX Motorcycle Crash Cases

When you’ve been injured in a Bay City, TX motorcycle crash because of another driver’s negligence, you need to be able to make a successful accident claim for financial compensation to cover your expenses after a wreck. Because motorcycles operate at high speeds just like any other vehicle, and yet they offer their riders little or no protection in the event of a crash, motorcycle accidents easily have the highest costs of any type of vehicle accident. Our Bay City motorcycle accident attorneys note that in a great many cases, they cost the rider his or her life.

Your great need for fair financial compensation after a Bay City, TX motorcycle crash doesn’t mean you’re going to get it, however. Texas observes the rule of modified comparative negligence, which means your proportional share of the fault in an accident is very important to your case.

The Role of Comparative Fault in your Injury Compensation Claim

And you can be sure that the defendants and their insurers are going to try their best to defend themselves against your injury compensation claim by putting as much of the blame for the accident on you as they can get away with. Our Bay City motorcycle accident attorneys point out that if they can put at least 50% of the blame for the accident on you, they don’t have to pay you a single cent in financial compensation. And insurance companies have years of experience and highly paid defense teams that could shift the blame back to innocent but inexperienced injury claimants with ease.

To make a successful injury compensation claim after your Bay City, TX motorcycle crash, you need the help of a Bay City motorcycle accident attorney with years of experience successfully representing injured motorcyclists. You need Tony Denena and Chad Points. How do You Choose the Right Galveston Personal Injury Law Firm for You?

To ensure that you have your best shot at a fair financial recovery after someone’s negligence has harmed you in a needless accident, you need the skilled help of an experienced Galveston personal injury law firm that is ready to go to trial for you if needed. Some law firms are only settlement mills.

That means that they will never go to trial for your cause. They will simply accept the best settlement offer that they can get on your behalf. And when determined defendants and their powerful insurance companies know that they’re facing a settlement mill that won’t challenge them to trial, they have no incentive to make you a worthwhile settlement offer.

A determined defendant and his insurance company will want to make you a quick cash settlement offer for your injuries before you’ve had a chance to hire a Galveston motorcycle accident attorney or to think about the long-term costs of your accident. They know serious injury accidents cause motorcyclists to bleed green as well as red. An unfair settlement offer that you accept right away as you’re facing mounting medical bills saves them money. And once you’ve accepted the offer, you’ve released your right to sue them for more money. They’re off the hook.

Accident victims with experienced, knowledgeable lawyers beside them stand far better chances of receiving fair financial compensation for their injuries. If defendants or insurers won’t offer you a fair settlement, an able Galveston motorcycle accident attorney could take them to trial.

  • Who all is at fault for the accident, and what share of the blame does each person bear?
  • What evidence do the opposing parties have, and how convincing is it?
  • How convincing is YOUR evidence?
  • Does the settlement offer cover the full costs from your accident?

You need a Board Certified Injury Attorney to win Your Alvin, TX Claim

OLYMPUS DIGITAL CAMERAAfter you’ve been injured by another person’s negligence in an Alvin, Texas accident, you’ll be left with mounting medical expenses and other costs that you’ll need help to pay. But the defendant and his insurance company won’t want to part with their assets to pay your expenses. And the law does not, in fact, require them to do so. So they will make every effort to deny or minimize the value of your claim and shift the blame for the accident back to you.

If the defendant can show that you’re at least half responsible for causing the Alvin, Texas accident, then he and his insurance company win. They don’t have to pay you anything.

To even have a chance at the financial compensation you deserve after your needless injury, the burden is on you to take affirmative steps to file a claim, gather necessary evidence to prove your case, and build a strong and convincing claim that jurors and insurers can’t deny. To do that, you need the skilled and knowledgeable help of a Texas Board Certified injury attorney like Chad Points or Tony Denena.

To receive Texas Board Certification in the specialized field of personal injury law, your attorney must prove competence well beyond the already tough standards that every Texas lawyer must meet.

A Texas Board Certified injury attorney must:

  • Have been licensed to practice law for at least 5 years. (At Denena Points, PC, our attorneys have been licensed and practicing law for more than 15 years.)

  • Demonstrate exemplary experience and involvement in the personal injury field of law by successfully handling a wide variety of matters in that specialty area. (Our successful case outcomes for our clients speak for themselves. Click on the Case Results page of our site to learn more.)
  • Pass a peer review by fellow lawyers and judges.
