Pedestrian – Car Accidents are on the Rise in Texas

The last few weeks have seen an upsurge in reports of Texas pedestrians struck by cars. Many of these reports describe fatal hit-and-run accidents. Some reports involve children struck by vehicles on their ways to or from school.

The rise in the number of reported pedestrian – car accidents in Texas seems most noticeable throughout the greater Houston metro area. But we’ve been seeing reports from all over Texas where pedestrians suffer debilitating or even fatal injuries from cars whose drivers often fail to stop and render aid.

Just a couple of days ago, I saw the report of a Seguin High School student who received serious injuries. A pickup truck struck the student, walking on his way to school, in the street almost right in front of the high school. The report says that the truck was not speeding, but that the school zone had not yet taken effect. So the truck might still have impacted the unprotected body of the young pedestrian at a fairly high rate of speed.

The student, a 14-year-old freshman at Seguin High School, received transport to the hospital via Airlife. News accounts placed him in stable condition. Accident responders did not issue a citation to the driver, who said he simply didn’t see the boy in the street.

Pedestrian – car accidents involve special legal issues and considerations. Comparative negligence often provides grounds for contention by opposing parties who don’t want to pay damages for the injuries they might have caused.

Insurance companies might be eager to settle your pedestrian – car accident case quickly, before the full extent of your injuries from the accident becomes known. After you accept a settlement, you can’t go back and ask for more money. Even though you may have found injuries emerging of a much greater magnitude than you initially thought you had, you’re limited by your settlement agreement.

Debilitating chronic pain, neck or spinal injuries, muscle and other soft tissue injuries can all take time to reveal themselves and their full extent after a pedestrian – car accident. You might find numbness in your limbs, a growing loss of mobility, or even cognitive impairment from mild brain trauma setting in. The quick cash settlement you accepted, which may have seemed generous at the time, won’t even begin to cover the costs of the long-term medical treatment you find you’ll need.

It’s important after any pedestrian – car accident that you consult with a competent accident attorney who can help you obtain diagnosis and medical treatment of any injuries from the accident. The longer you wait to seek treatment, the worse your injuries and chronic pain might become.
