Fatal Dump Truck Accidents in Austin and Dallas Highlight Texas Trend

The Texas dump truck accident attorneys at Denena Points, PC report two fatal dump truck accidents in Austin and Dallas to highlight a Texas trend. Research data on fatal heavy truck accidents reveals that dump truck crashes account for a substantial proportion of them, up to 33%. And most of these crashes occur in urban neighborhoods at intersections or where dump trucks enter and exit alleyways and other drives. Click the link to learn some important facts about heavy truck accidents.

On Tuesday afternoon in east Austin, Texas, a dump truck collided with a white sedan at the intersection of east MLK and E.M. Franklin Avenue and killed Ricky Monroe, 49. The crash also seriously injured a woman in the sedan. Our Texas dump truck accident attorneys are saddened to report that Mr. Monroe was Austin’s 57th traffic fatality of 2013, up from 52 fatalities at this time in 2012. (Source: Alex Penrose, KXAN, 9.12.13) We express our condolences to Mr. Monroe’s family and friends.

Also on Tuesday, in the morning around 11, a dump truck crashed into a white Lexus 350 on I-635 (LBJ Freeway) in Dallas near Marsh Lane. The dump truck, owned by Rizo Trucking of Garland, a subcontractor on the LBJ Express construction project, had just dumped a load when it went across a concrete divider and landed on the Lexus and another small car. The Lexus was pinned at the front of the truck, and the Mazda was trapped under the back of the truck on the other side of LBJ.

Our Texas dump truck accident attorneys sadly note the passing of Mr. And Mrs. TD Mullikin, Jr. of Trophy Club, who were in the Lexus and died at the scene of the tragic accident. We also report that Mr. Daniel Cerean, in the other car trapped by the heavy dump truck, was seriously injured in the crash. A Hazmat unit was also on the scene of the deadly heavy truck accident cleaning the large amount of diesel fuel that spilled from the truck in the wreck. (Sources: Robert Wilonsky, The Dallas Morning News; nbcdfw.com; and myfoxdfw.com, 9.10.13)

The Texas dump truck accident attorneys at Denena Points, PC have the deepest sympathies for the family and friends for the Mullikins in their time of loss. And our thoughts and prayers are also with Mr. Cerean and his family as he recovers from his injuries.

The Hazards of Driving in a Construction Zone like the LBJ Express Project

Dallas drivers have come to appreciate the dangers of traveling through the confusing construction zone of the LBJ Express construction project. That the dump truck jumped the concrete divider after dumping a load might indicate that driver fatigue was a contributing cause of the accident. But driver inattention as the trucker was coming off a job could also be to blame. Driver over-correction trying to evade an obstacle, driver medical conditions, or truck equipment failure are among the many other possible contributing factors to the wreck. Our Texas dump truck accident attorneys emphasize that a thorough accident investigation is required to be sure.

Driving through construction zones with the sudden bottlenecks and slow downs they require can be dangerous. Not just for drivers, but also for the workers in the construction zones. That’s part of the reason the Texas legislature just passed the new move over/slow down law relating to active TxDOT work sites.

Massive Costs Left in the Wake of a Devastating Dump Truck Crash and What to Do to Cope

When you or your loved ones have been harmed by a devastating dump truck accident, our Texas dump truck accident attorneys at Denena Points, PC understand that you might find unexpected difficulties in proving what seemed like your clear and valid personal injury or wrongful death claim.

In most heavy truck accidents, the driver who was in control of the truck at the time of the wreck will be at fault for the crash. When the driver is at fault, his employer could also be found legally liable for your injuries or losses through the doctrine of respondeat superior. This means that the employer is legally responsible for his employee’s actions while the driver is on the job for him.

The massive injuries and devastating loss of lives left in the wake of a serious heavy truck accident can leave families with huge medical bills and financial losses. The dump truck’s insurance policy, as well as the assets of the employer, could help pay for these enormous financial losses you’re suffering.

One thing that an experienced Texas dump truck accident attorney might look for in his investigation of the wreck is the driver’s prior violations. Serious driving violations like excessive speeding, reckless driving, or prior crashes could be used as evidence that the driver should have been disqualified from driving at the time of the wreck. A record of prior driving violations goes to employer liability as well, possibly indicating negligent hiring or failure to comply with regulations.

Obstacles Victims and Their Families Face as They try to Obtain Just Compensation after a Serious Dump Truck Crash

Insurance companies are very conscious of their bottom lines and profits. The companies are not happy to pay out huge amounts of compensation after a devastating heavy truck accident. To protect their high dollar truck insurance polices, the insurance companies might send aggressive insurance adjusters out to try to get you to make statements that would indicate that you or your family members were at fault in the accident.

Texas follows the rule of modified comparative negligence in determining fault and liability. When an accident victim can be found to be at least 50% responsible for causing the accident, then the insurance company does not have to pay the victim anything.

But in some crashes, even the most creative use of victim statements can’t shift the blame sufficiently to deflect a truck driver’s liability and the insurance company’s responsibility to pay. So the insurance adjuster could try to take advantage of your inexperience with such accidents and your emotional distress after a serious wreck to pressure you into accepting a fast cast settlement that greatly undervalues your claim. Or the insurance adjuster might try to get you to release your rights altogether.

Without the guidance of your experienced Texas dump truck accident attorney, you shouldn’t make any statements, sign anything, accept any settlements, or speak with opposing parties to the claim. Once you have accepted an undervalued settlement or released your rights, your action generally cannot be undone.

In Rusk County, Another Rear End Crash with a Semi Truck Claims a Life

Tuesday night a little after 11, Rudy Huddleston of Troup, Texas drove his Nissan Sentra into the back of a stopped tractor-trailer truck at the intersection of State Highways 64 and 42. Mr. Huddleston was pronounced dead at the scene of the tragic crash near Henderson in Rusk County. (Source: Tyler Morning Telegraph and KYTX CBS 19, 9/5/13) The East Texas wrongful death truck accident attorneys at Denena Points, PC express their condolences to the family and friends of Mr. Rudy Huddleston.

Mr. Huddleston’s tragic death was the second in a matter of days where a Texas driver fatally rear-ended a stopped tractor-trailer truck at night. Studies have shown that when such fatal truck wrecks occur, more than half the trucks have had previous lighting violations. Accounts of these two tragic wrecks did not indicate whether the trucks had working lights on their trailers or not.

Rudy Huddleston’s death is also one of about 20 Rusk County traffic deaths so far this year. Crash data reveals that traveling on Rusk County roads is about 6 times more deadly than average for U.S. roadways. Our East Texas wrongful death truck accident attorneys note that the average traffic fatality total in the U.S. is 5 per 100,000 people per year. Rusk County in East Texas has a population of only 60,000, but had already seen 17 traffic deaths by July. The numbers were so disturbing that county authorities hosted a summit to try and determine what was behind the disproportional fatality numbers and what to do about it.

By comparison with the current year, TxDOT said that in 2011, 751 crashes occurred in Rusk County. Of those, 12 accidents were fatal. Our East Texas wrongful death truck accident attorneys point out that the county had already surpassed the total number of 2011 Rusk County traffic deaths by the first half of 2013.

Rusk County probably suffers from a confluence of characteristics:

  • Winding East Texas roadways with lots of trees, animals in the roadway, and shorter sightlines;
  • The narrow, rural highways that traditionally account for the largest proportion of fatal crashes across the state of Texas;
  • Large amounts of heavy tractor-trailer truck traffic;
  • Drunken driving; and
  • Distracted driving.

Miles of Union Pacific Rail Crossing Guards Malfunction in San Antonio

Railroad_Crossing_(335631858)The Texas railroad crossing accident attorneys at Denena Points, PC note that Sunday night around 11:30, miles of Union Pacific rail crossing guards started to malfunction for unknown reasons in San Antonio, presenting a dangerous problem to motorists. The affected railroad crossing gates stretched for more than 8 miles along Highway 281 from about Jones Maltsberger to Commerce Street near downtown. The railroad crossing gate arms became stuck, frustrating and worrying late night travelers.

Union Pacific officials were investigating the bizarre malfunction and finally got the rail crossing guards working properly again about 1:30 the next morning. (Source: KABB Fox San Antonio, 9/2/13) Accounts of the dangerous Union Pacific rail crossing guard malfunction did not disclose the cause of the problem.

Our Texas railroad crossing accident attorneys cannot overemphasize the danger presented to drivers when rail crossing guard arms malfunction. Urban drivers rely on the signals to know when it’s safe to cross and when they must wait. When rail crossing arms become stuck, frustrated drivers weary of waiting and unable to rely on the signals to indicate the approach of an oncoming train may eventually take dangerous chances by driving around the arms and over the tracks. If a train should happen to come along at that time, the driver could find he’s made a fatal mistake.

Owners of the property where a rail line runs are generally responsible for installing and maintaining safety warnings, signals, and guard arms at railroad crossings. Union Pacific dutifully took charge of the malfunction in San Antonio on Sunday along its rail line.

Equipping a rail crossing with the gates, warning signals, and guard arms one sees at urban railroad crossings can cost over $100,000. Federal funds often help defray the costs of these warning signals and crossing guards in urban areas. But our Texas railroad crossing accident attorneys caution that private railroad crossings and many crossings in remote rural areas aren’t eligible for the federal funds that support crossing signals and warnings.

Our Texas railroad crossing accident attorneys point out that many rural railroad crossings only have a stop sign to warn drivers of possible danger. Private rail crossings may not even have a stop sign. That’s part of the reason why so many of the train collisions with trucks and cars that occur happen at rural crossings. Click the link to learn some safety tips to help you avoid being injured by a train at a railroad crossing.

Boy’s Tragic Death in Amarillo, Hit by 2 Freight Trains, is a Warning to Never Try and Beat a Train at a Railroad Crossing

Never try to beat a train at a railroad crossing. Our Texas train collision attorneys caution that if your vehicle stalls, your tires get caught in the tracks, or you just aren’t fast enough, the result could be serious injury or death. As a recent Amarillo train crash death reveals, bypassing crossing gates and trying to beat a train could be deadly for innocent victims.

On August 10, Edgar Rangel reportedly tried to drive his pickup truck around railroad crossing gates in Amarillo as two freight trains approached. A 4-year-old boy was in the truck with him. Rangel didn’t make it across the tracks in time, and the pickup truck was hit by BOTH freight trains. The boy was fatally ejected from the truck and Rangel was hospitalized for more than a week with his injuries after being hit by the two freight trains.

Our Texas train collision attorneys note that police have arrested Edgar Rangel and charged him with manslaughter, saying the train crash and reckless attempt to drive around the railroad crossing gates were alcohol-related. (Source: Associated Press, 8/20/13)

Every Day there are 6 or More Train Collisions in the United States

A train collides with a vehicle or a pedestrian somewhere in the United States every 3 to 4 hours. That’s 6 or more potentially fatal train collisions EACH DAY. Remember that drivers are required to stop at least 15 feet away from the railroad tracks when they see or hear:

  • A railroad crossing signal,
  • A lowered crossing gate bar across the tracks,
  • A flagger warning of a train’s approach, or
  • An approaching train.

The driver must stop until the railroad crossing warning signal also stops and it is safe to proceed. The Texas train collision attorneys at Denena Points, PC emphasize that vehicle collisions with trains are preventable with proper safety precautions. Drinking, driving, and trying to beat a train at a railroad crossing is reckless in the extreme. Your safety is in your hands. Don’t drink and drive. And don’t try to beat trains at crossings.

South Post Oak Garbage Truck Rollover Injuries Reveal Heavy Truck Risk

Monday afternoon just before 2:30, a garbage truck turned over onto a passenger car, sending three people to the hospital with serious injuries. The garbage truck rollover led to the closure of all eastbound lanes of the Sam Houston Tollway at South Post Oak Road in Houston. (Source: Robert Stanton, Houston Chronicle, 7/15/13)

The thoughts and prayers of our Houston garbage truck accident attorneys are with the injured victims of the rollover wreck.

The High Risk of Rollovers and Serious Accidents from Commercial Garbage Trucks

A number of factors such as road conditions, other driver behavior, or weather could cause a garbage truck to crash. Rollovers are one of the greatest risks. Our Houston garbage truck accident attorneys point out that the heavy garbage truck has a high center of gravity like that of a traditional dump truck or cement truck, both notorious for frequent rollovers and accidents. The load a garbage truck is hauling will shift the heavy truck’s center of gravity even higher than in its unloaded state.

It’s a persistent problem because truck designers that overcompensate for the expected weight of the loaded truck could cause additional instability and accidents risks for unloaded trucks. The awkward, high center of gravity could cause the truck (loaded or unloaded) to turn over as the driver is trying to take a curve or turn or if he’s driving too fast.

When a heavy garbage truck tips into a rollover, the results can be catastrophic. The heavy truck could easily crush other vehicles and their passengers, especially if it’s loaded. The simple weight of the heavy vehicle could cause very serious and even fatal injuries. Serious injuries might require ongoing medical care. Our Houston garbage truck accident attorneys know from experience that the severe injuries could reduce a person’s earning capacity due to disability, leading to heavy financial burdens for the injured accident victims and their families.

Trucks are Required by Law to Carry Large Amounts of Insurance

Because of the ever-present risk of serious and fatal injuries from heavy truck wrecks, garbage trucks are required to be insured in amounts that far surpass the level of the average passenger car policy. The value of a commercial truck insurance policy, on average, is 50 times that of a car insurance policy.

But obtaining the full financial compensation you deserve for your injuries could be challenging. Insurance companies hotly defend these insurance policies against the claims of accident victims. And truckers are not always cooperative when their driving record or their own insurance rates might suffer. Accident victims need a Houston garbage truck accident attorney like Chad Points or Tony Denena who has years of experience successfully winning fair financial recoveries for serious truck accident injuries.

La Marque TX Rear End Cash with Road Crew Truck Injures Woman on I-45

The Galveston Daily News (T.J. Auld, 6/14/13) reported that a woman driving a Kia on I-45 at night near Exit 10 slammed into the back of a road crew truck just before 10 p.m. The horrific crash sent the woman to a hospital in Galveston by ambulance.

The thoughts and prayers of our Galveston truck accident attorneys are with the injured woman, hoping for her complete and rapid recovery from her injuries.

What Caused the Nighttime Rear End Crash with the Road Crew Truck?

To obtain proper financial compensation when you’ve been injured in a crash with a truck, it’s important to be able to show what caused the wreck.

 FEMA_-_34115_-_Overturned_car_in_a_field_in_Tennessee

Our Galveston truck accident attorneys ask: Did the truck on I-45 not have lights or cones or other warnings in place? More and more often one sees road crew trucks pulled over without having any warnings out to alert oncoming motorists to their danger. Many commercial truck drivers of all sorts seem to be less and less inclined to abide by safety regulations and rules of the road, which could indicate weak enforcement.

In Dallas on Thursday, this writer watched a commercial truck on Audelia Road, with its rear license plate covered up and a green-lettered sign on the side that ironically enough said something like “Green Earth” or “Clean Earth,” driving in the left lane. The truck was entering ALL left turn lanes, and then NOT turning left. Instead, at each intersection the driver would immediately swerve right, out of the left turn lane and without warning or signals, back into traffic, almost causing wrecks. There was a sign on the back of the truck saying, “Keep back 100 feet.” But the people ahead of and beside him into which he appeared to be trying to steer could not see that sign.

In short, negligent and reckless truck drivers cause many of the crashes that injure innocent victims. Our Galveston truck accident attorneys call on witnesses to report these reckless drivers and on law enforcement officers to get them off the roads.

Ruben Galindo, Truck Driver who killed 4 in Fatal Hwy 90 Crash, Banned

In April, Ruben Galindo struck an SUV with a tractor-trailer while he was driving on the wrong side of Highway 90 near Kriewald Road. Our Alvin, TX truck accident attorneys sadly note that the catastrophic collision with the tractor-trailer truck killed the Koontz family of 4 in the SUV. Galindo reportedly told police that he had drunk two 16-ounce beers prior to getting behind the wheel. He was charged with four counts of intoxication manslaughter in the crime.

You’re probably aware that it’s against the law to drive a truck under the influence of alcohol. So the FMCSA (Federal Motor Carrier Safety Administration), which oversees truck drivers, has banned Ruben Galindo from driving commercial vehicles outside of Texas.

That’s according to the article in the San Antonio Express-News on May 23, 2013. If that is the case, our Alvin, TX truck accident attorneys wonder why the FMCSA has not barred Galindo from driving commercial vehicles inside Texas as well, since inside Texas on Highway 90 is where he killed a family of four in a crash. If the FMCSA must wait for the Texas State agency to strip Galindo of his commercial driving privileges, we only hope that Texas steps forward to do so.

Trucks are massive and cars and SUVs are no match for them in a collision situation. Our Alvin, TX truck accident attorneys periodically discuss the dangers of truck driver fatigue, a chronic problem on Texas roadways, particularly in the oil boom regions. But driving a tractor-trailer under the influence of alcohol on the wrong side of the road is such a deadly act that its potential should not be tolerated.

Distracted Driving leads to Serious Crashes like the Multi Vehicle Pileup on I-35

OLYMPUS DIGITAL CAMERAThe U.S. NHTSA has charted a sharp increase in the use of cell phones while driving over the past decade. But cell phone use and texting while driving are only two of the many things that could fatally distract a driver behind the wheel.

In a recent year, NHTSA data showed that distracted driving caused 5,331 of 34,017 fatal traffic accidents. Those accidents claimed 5,870 lives. And distracted driving is an underreported cause of fatal traffic accidents because after the fact, there is often no one left to say that the driver had been reaching for a snack or changing the music in a car just before the fatal crash.

Multi-Vehicle Pileup on I-35 near Troy, Texas

Early Saturday afternoon, a car and a tractor-trailer truck crashed in a chain reaction wreck on southbound I-35 that drew in three more vehicles. Our I-35 injury accident attorneys sadly note that at least two children were hospitalized with injuries from the accident. Then shortly afterwards, a wreck occurred on the northbound side of I-35. Witnesses said that drivers who were not paying attention to their driving tasks were responsible for causing the serious crash. (Source: Nichole Perez, kwtx.com, 5/23/13)

This sequence of distracted driving wrecks on I-35 on Saturday demonstrates that distracted driving crashes are not an isolated or rare phenomenon. Like many states, Texas has begun to pass new laws intended to begin to curb cell phone use behind the wheel at least in school zones. But our I-35 injury accident attorneys emphasize that your risk of being injured in a serious rash caused by a distracted driver is higher than ever.

Any Serious Accident with Injuries can have Heavy Financial Consequences

You or your loved one might be out of work for some time to recover from your injuries. Our I-35 injury accident attorneys caution that you could be left with permanent disabilities. Medical bills from a period of hospitalization could continue to mount as you face the costs of ongoing medical care required by your injuries. You may face high costs to repair or replace your vehicle. The distracted driver who caused your accident might not even be insured. Big Rig Jackknifes, Spills Fuel in Another I-10 Downtown Houston Wreck

Friday morning around 3:30, an 18-wheeler carrying combustible lacquer and fire hydrant fluids reportedly took a curve at excessive speed, lost control, hit a concrete barrier, spun, and jackknifed on I-10 in downtown Houston. The 18-wheeler crash damaged the big rig’s cab and spilled over 100 gallons of diesel fuel onto the busy I-10 artery. Authorities closed several lanes of I-10 for hours while HAZMAT crews cleaned the spill. The 18-wheeler driver received a citation for failure to maintain a single lane. (Source: Courtney Gilmore, KPRC click2houston.com, 5/10/13)

Overturned Big Rigs almost a Daily Sight on I-10 in Downtown Houston

We note that a lane citation seems a minor penalty for an act that could have resulted in a major fireball on I-10. The Houston 18-wheeler accident attorneys at Denena Points, PC mention that it was just about a day ago that we wrote about another big rig driver who lost control of his vehicle and ended up spilling rolls of paper all over I-10. The wreck tied up traffic for hours. 18-wheeler wrecks are becoming so common on the interstate that you could practically bank on annoying delays in your daily commute from drivers who take curves, ramps, and lane changes too fast.

And our Houston 18-wheeler accident attorneys note that many of these big rigs are not only carrying their own diesel fuel, which could spill and ignite in a wreck or a rollover. They are also carrying as their cargo substances like oil, gas, and lacquer that could erupt in a ball of flame in a serious crash. When you drive I-10, you’re at risk from these fast-traveling behemoths.

Contact the Houston 18-Wheeler Accident Attorneys at Denena Points, PC if a Big Rig has injured you or Your Loved One

We believe that needlessly injured 18-wheeler accident victims deserve strong advocacy and protection of their rights against the big trucking companies and powerful insurance companies that seek to minimize the value of their losses. We could help you hold those companies accountable for the losses that a careless truck driver has inflicted on you.

Call us today at 281-369-4363 or fill out our online contact form to schedule a FREE initial legal consultation to discuss your injuries. We will meet with you face to face to hear your story. You have no obligation to hire an attorney. And our in-depth knowledge of 18-wheeler accident injury claims could help you make informed decisions about your future following a serious accident.

Rising Number of Texas Pedestrian Deaths, 2 from Recent Vehicle Crashes

Monday night around 8 p.m., our Galveston pedestrian injury lawyers sadly note that a man walking beside eastbound U.S. 290 in Houston was struck and killed by the driver of an 18-wheeler. The 18-wheeler driver apparently did not see the pedestrian walking on the elevated highway in time to prevent the accident.

And a day before on Sunday afternoon, 8-year-old Jazmin Alvarez was tragically stuck and killed by a vehicle as she walked with a group of children to a local store in Conroe, Texas. The driver that struck her, Byron Smith, reportedly did not have time to stop as the young girl ran out into the road in her enthusiasm to reach her destination.

Our Galveston pedestrian injury lawyers note that Texas is not a particularly friendly state to pedestrians and bicyclists. Generally, Texas with its wide expanses is all about cars. So the number of pedestrian and bicyclist injuries and deaths is rising. And all over the nation, the high risk of motor vehicle crash injuries and fatalities remains a problem for more vulnerable pedestrians and bicyclists.

In 2010 for instance, the U.S. NHTSA says that 4,280 pedestrians died and approximately 70,000 received injuries in motor vehicle crashes. 620 bicyclists died and another 52,000 were injured by vehicles in that year.

Pedestrians and bicyclists account for around 14% of traffic fatalities, yet they make up 12% or less of all trips, revealing the disproportionate risk they face on the roads. More than 20% of bicyclist injuries and fatalities occur at night, when drivers have more trouble seeing them in time to avoid an accident. The risk is similar for pedestrians at night.

The hearts and prayers of our Galveston pedestrian injury lawyers are with all the injured victims and the family members of tragically killed victims of Texas motor vehicle crashes. Click the link to learn about important pedestrian safety tips that could help save you and your loved ones.
