Lack of Infrastructure Improvements could lead to Structural Collapses

Data compiled by investment research firm BCA Research reveals that over the last few years since 2010, federal infrastructure spending unrelated to defense has declined by around $60 billion from an average of about $300 billion per year. In contrast, the structural collapse injury attorneys at Denena Points, PC mention that the American Society of Civil Engineers says that federal infrastructure spending should be approximately $450 billion per year in order to get the U.S. infrastructure back up to a reasonably safe and workable level by 2020. (Sources: Alan Pyke, thinkprogress.org; and BCA Research investment research firm, 11/1/13)

Our structural collapse injury attorneys point out that a great many of America’s highways, bridges, and other essential transportation infrastructure elements were built in the era from the 1940s to the 1960s. Some of those structures are beginning to strongly show their age and accumulated weaknesses.

 1971_San_Fernando_highway_overpass_collapse

Engineers regularly inspect bridges, overpasses, and other essential structures to rank their safety and priority in terms of need for repairs. In recent years, that data has become ever more depressing, and government officials more reluctant to publish the data. The City of Los Angeles was in the news just last week struggling to obtain a report on which of the city’s aging concrete structures were most in danger of collapsing in the event of an earthquake. Authorities did not want to release the data. Given Los Angeles’ location in an area prone to earthquakes, that data is pretty relevant to urban planning there.

To keep the U.S. transportation infrastructure functional, the investments in improvements will eventually need to be made anyway. But there’s a good chance that if made later rather than sooner, costs will be higher. Our structural collapse injury attorneys caution that costs might be higher in terms of lives as well, if bridges and overpasses collapse suddenly in the meantime.

Democrats are suggesting that the creation of a national infrastructure bank with a $10 billion initial investment will provide an ongoing funding stream for infrastructure projects. The structural collapse injury attorneys at Denena Points, PC suggest you beware. Look before you leap off any fiscal cliffs.

What happens whenever you aggregate large sums of money in one place and give government officials access to those funds? They tend to loot those funds and waste the money in futile pursuits for which the funds were never intended. Some of you might recall back when the Clinton campaign and then Administration was going on about the sizable deficit (which has nothing on today’s deficit, by the way). And then the Clinton Administration suddenly announced that there was no longer a deficit but a substantial surplus….

Where did that surplus come from? Did Harry Potter wave his magic wand and just bring it into being? No (and seriously, why would he even do that for the colonies across the pond?), the Administration apparently looted the Social Security fund, which is now struggling. And many of us will never see a dime from our Social Security contributions in part due to that sudden, magic Administration surplus. So we’re just saying: think twice before you fall for any of these “one time initial investment” schemes. In our world, unlike Harry Potter’s, there just aren’t any magic solutions.

Winds cause Improperly Installed Construction Fence Collapse Injuries

A line of storms has been passing through the New York City area this past week. The construction fence injury attorneys at Denena Points, PC note that high winds and improper, inadequate installation are blamed are blamed for the devastating collapse of a construction fence and scaffolding that injured three people on Friday. The fence was in the busy Midtown tourist and shopping area on 40th Street between Broadway and 7th Avenue. The New York City Department of Buildings (DOB) says that the construction fence was installed “contrary to approved plans.” A full Stop Work Order has been issued at the site of the collapse.

The scaffolding at the site blew down and landed atop three people, trapping them. Some Good Samaritans pulled debris off of two trapped women among the three victims. The construction fence collapse victims were hospitalized at Bellevue. A firefighter also sustained injuries while responding to the accident and was sent to a different hospital. (Source: abclocal.go.com/wabc)

The DOB had issued a warning to property owners on Friday to secure construction sites and various buildings due to the high storm winds, which can bring down weak building facades as well as temporary construction bracings, barriers, and cranes.

Shortly afterwards, another structural collapse occurred in Midtown on Saturday, killing 4 and injuring more than a dozen. Our construction fence injury attorneys mention that reports of the incident do not indicate whether it was due to the high storm winds or failure to take proper safety precautions. Two Construction Workers Injured in Fall after Brunswick Roof Collapse

A construction worker helping to build a storage addition onto Custom Decks by Klassic on Center Road in Brunswick, Ohio fell around 20 feet on Thursday morning about 8:30 and received serious injuries to his head, chest, and wrist when the roof collapsed. He was hospitalized in stable condition. The building collapse injury attorneys at Denena Points, PC note that another worker also received injuries and was treated at the scene of the Brunswick roof collapse.

The construction of the addition had been subcontracted to On Site Management. The two workers were in the process of installing the trusses on the addition when the roof collapse occurred. The trusses formed part of a pre-engineered system and came with manufacturer’s instructions regarding proper installation and assembly.

The manufacturer’s instructions said to put in lateral and gable end supports before installing the trusses. But the chief building inspector for the city of Brunswick indicated that the construction team had not followed these instructions and had not installed supports.

According to the chief inspector, only one temporary brace had been placed in the structure when a project of the size of the addition would have required several temporary braces at that stage of construction to be safe. The workers also had not been using hard hats or safety anchors while they worked, both safety violations. And our building collapse injury attorneys point out that neither the On Site Management contractor or Project Manager was on site at the time of the accident.

OSHA was investigating the Brunswick roof collapse accident. The chief building inspector said that the contractor and project manager could likely expect several safety violation citations. (Source: Melissa Martin, The Post Newspapers, 9/5/13)

Construction workers’ employers are responsible for providing proper training and equipment to ensure their safety. If workers are injured because employers failed to provide adequate training or safety equipment, the employer could be liable for the full financial value of the worker’s injuries and pain from resulting accident. Continue to Part 2 to learn more.

Holding Employers Liable in Roof Collapse Injury Cases

Continued from Part 1. Falling is one of the Fatal Four most frequent causes of construction worker deaths and injuries. U.S. OSHA has sought to reduce the numbers of construction worker deaths and injuries from falls by promulgating detailed rules that employers must follow to ensure their workers’ safety. Chief among these rules are extensive requirements regarding worker training, safety equipment, and fall prevention measures.

When a serious accident occurs and OSHA investigates, OSHA can fine the employer for any safety violations it finds, as the agency seems likely to do for the roof collapse in Brunswick. But OSHA’s investigations and fines won‘t directly help the injured workers. To hold the employer financially responsible for causing the injuries by failing to provide proper training and safety equipment, the workers generally need their own roof collapse injury attorneys who are experienced with the complexities of structural collapse cases and safety requirements.

Let’s Look at Some of the Common Factors in Roof Collapse Injury Cases

The recent roof collapse in Brunswick on an addition under construction that injured two construction workers clearly reveals the critical importance of adequate temporary bracing during construction and demolition operations.

The disastrous, deadly demolition collapse of a Philadelphia building into a Salvation Army Thrift Store has also been attributed in part to lack of adequate temporary bracing while the building was being taken down. Numerous reports have indicated that the entire demolition operation seems to have been hasty and improperly done. Lack of adequate bracing was only one of the problems.

And the lack of proper temporary bracing seems to go back in part to disputes between the lawyers of the building owner and demolition company and the Salvation Army. The lawyers were still wrangling about how to best proceed on the job when the demolition workers decided to get started anyway. Our roof collapse injury attorneys note that it’s not as unusual as you might think for clients to disregard the advice and admonitions of their lawyers and to simply go ahead with what they want rather than what might be most beneficial.

Improper Roof Truss Installation and Roof Collapses

When installing roof trusses, it’s important to properly calculate the loads that the trusses will have to support. Builders should also see to proper temporary bracing as we’ve mentioned, and to proper connections to the building’s other supporting members.

Building experts warn against the common habit of storing building materials and equipment on the roof and its trusses during construction. Such overloading, especially in combination with weak bracing, can lead to sudden roof collapses.

Pre-engineered roof trusses are a common feature in the building industry and are often pre-ordered and delivered to a building site. As the Brunswick roof collapse demonstrates, it’s vital to construct and install roof trusses in accordance with manufacturer’s instructions and design documents. Our roof collapse injury attorneys emphasize that the manufacturer’s designers and engineers spent time accurately calculating weight loads, spans, and spacing of the pre-engineered roof trusses for a good reason.

Installation errors, damage to a truss or a component, or field modifications by construction workers to accommodate (for example) skylights, chimneys, or other roof openings could drastically affect the weight load that a truss can support. The roof could suddenly collapse and cause catastrophic or fatal injuries from falls and entrapment under heavy debris.

Roof Trusses, Worker Training, and Roof Collapse Accident Injuries

Continued from Part 2. Unfortunately, it’s not uncommon for workers assembling and installing pre-fabricated or pre-engineered structures to disregard some or all of the manufacturer’s instructions. The roof collapse injury lawyers at Denena Points, PC emphasize that this disregard frequently leads to collapse of the structure and to severe injuries even before the building gets completed.

Manufacturers provide the instructions based on their tests of things like stress tolerances, connector strength, and support spacing to ensure the safety both of workers and those who will use the completed structure. Proper roof truss installing in a building under construction requires properly trained and skilled crewmembers to build a safe and sturdy roof support system. Part of this effort requires employers to properly train their workers. Our roof collapse injury lawyers point out that the employers must train their workers to follow manufacturers’ instructions when installing pre-engineered building elements.

Cutting or modifying a single member of a roof truss system, for instance, will compromise the structural integrity of the structure. But it won’t necessarily lead to a catastrophic roof collapse. Our roof collapse injury lawyers note that a more common contributor to collapse is improper temporary or permanent bracing against walls and girders.

Structural Elements of Roof Support

  • Joist – a horizontal support beam that extends from wall to wall, from a wall to a support beam, or between two beams.
  • Rafter – a sloped structural support in a roof that extends from the ridgeline down to the perimeter or eaves. A rafter serves to support the roof and its load.
  • Truss – a stress bearing support member consisting of triangular units connected by straight, linear units. The construction industry uses trusses for framing roofs and for ridges. Roof trusses support and stabilize a roof structure. Trusses take the stress of the roof load off of the connecting walls.

Ceiling joists and rafters together can form triangular roof trusses. But as in the Brunswick addition, contractors can also order pre-engineered roof trusses that are made offsite. Our roof collapse injury lawyers mention that these variations in the roof framing components have a common purpose: to support the roof and any load the roof itself might bear. The intersecting angles, particularly in the triangular truss formation, distribute the stress load, rather than sending it all straight out to the walls of the structure, which would force the walls outward and apart, leading to a structural collapse.

When the roof framing arrangement does not work properly, or is improperly installed or braced, the roof might give way and collapse, as just occurred in Brunswick. Click the link to learn more about the critical importance of strong roof truss systems.

Demolition Contractor’s Insurer Dodging Philly Building Collapse Costs?

Many of you might already be familiar with the growing controversies and complexities surrounding the tragedy caused by the collapse of a Center City Philadelphia building into the neighboring Salvation Army Thrift Store. The building collapse injury lawyers at Denena Points, PC relate that the building was undergoing demolition when it collapsed through the roof of the thrift store, killing 6 shoppers and employees and injuring others. One survivor had to have both legs amputated due to the severity of her injuries.

The injured victims may face a lifetime of disability, and the family members of the deceased victims face a life greatly altered without their loved ones. All because the demolition contracting company and the Salvation Army couldn’t cooperate; the City wouldn’t intervene to help settle the matter and enforce safe working practices; demolition rules and safety standards in Philadelphia were lax in the first place; and no one seemed to care to bother to seriously enforce what standards were available.

OK, that’s over-simplifying the matter, but you get the picture. This writer had read a couple of media accounts citing statements and actions and inactions of the Nutter Administration before realizing that Nutter was actually the name of the mayor.

Insurer of Demolition Contractor Seeks to Avoid Payouts on the Building Collapse

Now, to add insult to the injuries already heaped upon the victims of the tragic Center City tragedy, our building collapse injury lawyers learn that the insurer of demolition contractor Griffin Campbell is claiming that his insurance policy was invalid and/or cancelled prior to the accident. The insurance company, Berkley Assurance Co. of Iowa, is asking a court to confirm this. The insurer would no doubt like to avoid paying the massive costs of the disaster. (Source: The Washington Post by way of Katerina Sokou, The Philadelphia Inquirer, and the Associated Press, 8/7/13)

News reports indicate that the building’s owner, Richard Basciano/STB Investments Corp., was also insured under the same policy. Possibly (though I would hesitate to presume), the building owner also has other insurance policies pertaining specifically to his interests.

On Other Options Where There’s No Insurance

In accident injury and wrongful death cases, very often the monetary compensation awarded to the victims or their surviving family members gets paid by the insurer of the party or parties that caused the accident and its harmful consequences. Where insurance is lacking, our building collapse injury lawyers point out that sometimes victims might go after the personal assets of the parties.

But that quest presents a challenge. One that the demolition contractor appears to have taken pains to meet. One news story mentioned that he had declared bankruptcy no less than twice in the past three years. He has also previously pleaded guilty to the crime of insurance fraud (2009). Other news stories have mentioned a lack of demolition qualifications and a criminal history. They have also characterized the building’s owner, Richard Basciano, as a king of porn who once dominated the seedy peep show scene in Manhattan’s Times Square. Our building collapse injury lawyers mention that Times Square has since been cleaned and sanitized.

Blame Game: Everyone’s Responsible for the Building Collapse, and Yet No One’s Responsible?

The City of Philadelphia has been trying to disclaim responsibility in the Center City building collapse, as has the Salvation Army. It’s a case where all the parties (except the victims) seem to have been responsible for causing the tragedy. And yet they all fervently deny responsibility, leaving the victims and their families in the lurch.

The building collapse injury lawyers at Denena Points, PC wish the victims and the grieving families all good success in their quests for just compensation after the needless Philadelphia building collapse tragedy. Gas Leak Explosion Destroys Homes, Hospitalizes 8 in Philadelphia

A contractor was working on rehabilitating a vacant home, and residents said they smelled gas and then heard the explosion that collapsed the house undergoing renovation and the two homes adjacent to it. The Monday explosion and fire on Daly Street also led to the evacuation of about 70 other homes in south Philadelphia. Our experienced building collapse injury attorneys sympathize with the residents of the collapsed buildings, who were taken unawares by the sudden explosion and fire.

Witnesses to the horrific accident reported seeing firemen dousing a badly burned man with water, and a girl on fire tossing a baby out of a window to waiting firemen who caught the child. 8 people were hospitalized from the gas explosion in south Philadelphia, including a man, woman, and baby who were in one of the three homes that collapsed.

At least one of the 8 victims was in critical condition with severe burns. Officials said that everyone had been accounted for after the disaster, but fire rescue personnel were using listening devices as they sorted through the approximately 15 feet of piled debris and rubble left by the explosion. Gas has been shut off on Daly Street where the explosion occurred, and authorities have begun investigating to try and determine the cause of the sudden gas explosion. (Sources: Elwyn Lopez and Catherine E. Shoichet, CNN; and Daniel Kelley, Reuters; 7/29/13)

The hearts and prayers of the building collapse injury attorneys at Denena Points, PC are with all of the victims of the gas explosion in south Philadelphia and with their families as they cope with the aftermath of the traumatic event.

Explosions, Fires, and Building Collapses

file00024700115Explosions and fires can weaken buildings in unpredictable ways and lead to partial and total structural collapses. Our veteran building collapse injury attorneys note that firefighters often face their greatest risks of injury and fatality not from the fires themselves, but from the structural collapses brought about by these fires. There are many factors that might trigger a gas explosion and fire. So investigations of horrific accidents like the gas explosion in south Philadelphia might take many weeks before finally determining actual causes of the disasters.

Sometimes construction work ruptures or loosens a natural gas conduit. Sometimes, as in a recent case in Chinatown in New York City, carelessly leaving a pilot light burning in an appliance as you set off a few dozen bug bombs will blow your residential area apart. Click the link to learn more about the structural collapse hazards caused by explosions and fires.

Another Deck Falls off Another Home, Hospitalizing 14 in Tinley Park

Saturday night just after 9, a deck broke away from a home during a birthday party on Beverly Avenue in the Tinley Park suburb of Chicago. Between 30 and 35 people were standing on the deck at the time. Our deck collapse injury attorneys note that when the deck pulled away from where it had been attached to the house, it tilted towards the home, dumping people to the ground below. A neighbor indicated that the Tinley Park deck collapse resulted in some chaos, with “a lot of screaming” and bleeding injuries.

14 people were hospitalized after the Tinley Park deck collapse, one with very serious injuries, but according to fire rescue spokesmen, no one became entrapped in the debris and none of the injuries were life threatening. (Sources: Andrea Darlas, Chicago Tribune; and WGN TV, 7/28/13) The good wishes of our deck collapse injury attorneys go out to the victims of this unfortunate accident, hoping that they all recovery swiftly and completely from their injuries.

This has been a Summer of One Major Deck Collapse after Another

It seems to our deck collapse injury attorneys as if this summer’s news has reported one major deck collapse after another. Early summer heralded the spate of deck collapses with the report of a deck collapse at Shuckers sports bar near Miami that dumped over 100 people into Biscayne Bay. That should have been a wake-up call to everyone to get their decks thoroughly inspected and repaired or replaced, if necessary.

A deck most often fails at the point where it connects to the house or main structure, as apparently occurred in the Tinley Park deck collapse. Weak connections that aren’t adequately anchored in are often to blame. A surprising number of builders use nails, rather than bolts, to connect a deck to the main building, which is a recipe for disaster. Sometimes inadequate flashing (a layer of material protecting the connection from water damage) allows moisture to seep into a structure and rot to set in. Sometimes wood rots and hardware corrodes. Or inadequate supports allow load stress to gradually pull connections loose until the deck finally falls.

Whatever the actual causes(s), our deck collapse injury attorneys emphasize that serious, incapacitating, and fatal injuries could result. Often, as with the Tinley Park deck collapse, the cause of the deck failure is difficult to pinpoint and can take a thorough investigation by qualified experts to determine. At other times, such as where nails connect a deck to a home, the cause is clear.

Check Your Texas Balcony Railings and Deck Railings Often for Safety

In April of this year, a woman died and a man received critical injuries when the railing of a third-story balcony failed and sent them toppling to the ground below. Our balcony collapse attorneys sadly note that 26-year-old Alisha Wilhite died at Parkland Memorial Hospital after the railing on the balcony at The Mansions at Sunset Ridge collapsed in the 1400 block of Carrollton Parkway in North Texas.

Balcony railings and deck railings might suddenly fail even if the balcony or deck remains standing. The cause might be loosened or corroded structural connections; split, rotten, or cracked wood in the rails; or simply the age of the structure.

On the Safe Lifespan of an Outdoor Wooden Balcony or Deck

Many people are unaware that wooden balconies and decks have an average safe lifespan of only 15 to 20 years. These structures and their railings need to be thoroughly inspected for safety at least once per year. Our balcony collapse attorneys emphasize that any wobbling or “give” in the railings might indicate that they need immediate repair or replacement.

If your weight is resting on a balcony and the balcony railing gives way, you could receive serious or even fatal injuries in the resulting fall. Click the link to learn more about balcony and deck safety, and how to properly inspect and maintain your wooden outdoor structures to avoid potential injuries and liabilities.

Neptune Beach House that Injured 8 in Balcony Fall Condemned for Rot

The 3-story building in Neptune Beach, Florida where a balcony collapsed and injured 8 people, some seriously, stands at the corner of First Street and Margaret. Our balcony collapse injury lawyers note that Ernest Russell Jr owns the rental property.

Inspectors sent to the 3-story rental property after the catastrophic Neptune Beach balcony collapse found serious problems throughout the structure that led them to condemn the building and order the residents to vacate for their safety. What they found has reportedly also led them to start inspecting other rental properties owned by Ernest Russell Jr.

Problems found during the inspection include:

  • Improper wood;
  • Improperly attached wood; and
  • Rotten wood.

Our balcony collapse injury lawyers have seen some comments taking issue with how many people might have been on the balcony at the time of its collapse, and how actively they were moving about. But we doubt that the number of people or their activity was truly significant.

Rotten Wood Likely Meant the Balconies could have Collapsed at Any Time

The inspection report indicated improper construction and rotten wood. The balcony could have likely collapsed at any time, and the Fourth of July party merely hastened the inevitable.

The 3-story house in Neptune Beach where the balcony collapse occurred has been condemned and residents were forced to vacate because inspectors and officials appeared to believe that the other 3 balconies on the house were also rotten and improperly connected and could fall at any time.

One neighbor in Neptune Beach indicated that the traumatic accident has led him to consider having his own balcony inspected for safety. (Sources: Vic Micolucci, news4jax.com, 7/4/13; and Khristopher J. Brooks, Jacksonville.com, 7/5/13)

Our balcony collapse injury lawyers urge everyone with outdoor balconies, decks, porches, or stairways to have them inspected at least once yearly for safety. Especially if you live in a coastal climate, rot and corrosion could deteriorate the structures to unsafe levels very quickly. Ongoing maintenance and repair is critical to the safety of wooden outdoor structures.
