Atlanta Braves’ 2nd Baseman Dan Uggla Being Sued by Friend over TN Deck Collapse
Franklin, TN lawsuit: Dan Uggla deck rail collapse. Charles Grogan, a friend of Dan Uggla, is suing his friend the baseball pro, building Inspector Jerry Black, and David Mahand of Classic Southern Homes Inc. for $5 million in damages. Charles Grogan seeks damages for traumatic brain injuries and spinal fractures he suffered when the 2nd story deck rail he was leaning on at Mr. Uggla’s Franklin, TN home collapsed and sent him tumbling about 15 feet to land awkwardly on the concrete below. The deck rail collapse and fall occurred in October 2010, shortly after the major league baseball season ended.
News reports say that Dan Uggla, who grew up in Tennessee, purchased the nearly 6,000 square foot Franklin, TN home for $1.05 million in the fall of 2010. Last winter, Dan Uggla signed a 5-year contract extension with the Atlanta Braves. The baseball star has the longest hitting streak in the Braves’ history, with 5 consecutive seasons of 30 or more home runs.
Tennessee does not seem to require a home inspection prior to purchase. But most lawyers and many realtors suggest it as a way to avoid unpleasant surprises further down the line. Licensed realtors owe their clients a fiduciary duty. To satisfy that duty, we feel that realtors should take it upon themselves to have a thorough inspection by a licensed and reputable building inspector prior to selling a home to a buyer. That buyer may be relying upon the realtor’s knowledge of the property and its condition.
News reports say that Dan Uggla bears no animosity towards Charles Grogan, the victim of the Franklin, TN deck rail collapse that has filed a personal injury lawsuit. (And Charles Grogan probably does not pursue his lawsuit out of any animosity. His fall and consequent spinal and brain injuries have probably left him with staggering medical bills. He no doubt needs the financial compensation he could recover for his injuries to cope with his medical expenses and ongoing medical care requirements.) News reports don’t specifically mention Dan Uggla’s feelings towards the realtor and home inspector.
