Saturday afternoon around 2:30 saw the first traffic fatality of the New Year for the Yorktown, Texas area in DeWitt County. That’s when a tire blew out on a cement truck driven by Albert Lee Garza. Garza lost control of the westbound truck after the blowout and veered into the eastbound lanes ofFM 237 about 5 miles south of Yorktown. His cement truck struck a white tractor-trailer truck head-on, which then struck a red Chevy Silverado driven by Pedro Gonzales, 61.
Our Texas truck accident lawyers note that the cement truck then lost its cement tub, careened into a ditch and through a fence before finally coming to a stop with major damage. Pedro Gonzales received air transport to Citizens Medical Center where he later died from his truck crash injuries. His wife, Diana Gonzales, was listed in stable condition.
Albert Lee Garza and Clarence Brown and Gary Harriman, who were both in the white tractor-trailer-truck, received transport to the hospital for their injuries but have been released. Texas DPS troopers had the roadway closed down until well after midnight to clear the scene and investigate the accident. The accident is ongoing, but it appears that a blown tire on the cement truck precipitated the fatal 3-truck crash. (Sources: Yorktown News and Victoria Advocate, 1/14/13 and 1/13/13)

Truck Owners and Trucking Companies have a Legal Duty to Safely Maintain their Trucks, including the Tires
Due to the hazards posed by commercial trucks weighing up to 40 tons sharing the roads with much lighter passenger vehicles, federal and local regulations set safety standards for truck maintenance and cargo handling. Regulations require that trucks be regularly inspected and weighed, and that drivers take sufficient rest breaks to deter driver fatigue and the dangers of falling asleep behind the wheel. But truckers and trucking companies, pressured by the necessity to make the greatest number of deliveries in the shortest amount of time in order to compete, have found ways to dodge the regulatory requirements.
If you or your loved ones have been the victims of an accident caused by inadequate truck maintenance, you deserve full financial compensation for your injuries and needless losses. Contact our Texas truck accident lawyers today for a free legal consultation to discuss the specifics of your accident and your eligibility for financial recovery.
