Texas motorcycle helmet laws

Motorcyclists are at risk of sustaining serious injuries in a motorcycle wreck, especially if they choose not to wear a helmet. Wearing a helmet while riding a motorcycle can prevent head injuries that can cause death. Since 1997, however, Texas has made helmets optional for some motorcyclists.

Helmet Law

In Texas, the law prohibits anyone from operating a motorcycle or riding as a passenger on a motorcycle without wearing a helmet that meets the safety standards prescribed by law. An exception to this law applies if the rider meets the following requirements:

  • The rider is at least twenty-one years old; and
  • The rider has completed a motorcycle training and safety course or the rider is covered by a health insurance plan that provides the rider with medical benefits that cover injuries sustained in a motorcycle accident.

The law prohibits a police officer from stopping a motorcycle rider for the sole purpose of determining whether the rider is exempt under Texas motorcycle helmet law.

Recovering Compensation for Your Houston Motorcycle Wreck

A helmet can protect a rider from sustaining serious head injuries. Even if you were not wearing a helmet, you may be entitled to compensation for your injuries if another person caused the motorcycle wreck. Motorcycle riders can incur serious injuries—regardless of whether the rider was wearing a helmet—like abrasions, amputations, spinal cord damage, or trauma to the head. Treating these types of injuries is expensive, and the patient may require lifetime treatment.

A motorcycle accident attorney specializes in helping the victims of motorcycle wrecks receive compensation for medical treatment, lost wages, and pain and suffering.
