Physician and Pharmacy Agree to Settle Claim of Young Houston Girl that Mis-prescribing of Dangerous Drug Caused Her Blindness

A Houston ophthalmologist and his insurance carrier have agreed to a settlement with a teenage girl, Jane Doe, over blindness caused by the improper prescribing of a potentially dangerous eye drug. Additionally, the pharmacy that provided the drugs has agreed to settlement.

Jane Doe had chronic itchy, red eyes so her parents took her to a medical doctor. Although several drugs were available to the ophthalmologist, the physician prescribed a steroid based medicine with multiple refills. Prescribing multiple refills is contraindicated and is known to lead to serious side effects. Amazingly, he allowed for five refills of each.

The last line of defense for this young girl and her family was the pharmacy which should have been aware of the improper refills. The pharmacy failed the family and filled all of the refills.

Predictably, young Doe’s intraocular eye pressure went dangerously high and her eyes were severely and permanently damaged.

This case was filed prior to the dramatic and unjust law change in Texas that caps damages against negligent healthcare providers. The majority of the settlement was structured for the future use and benefit of the young teen.
