Ford Agrees to Settle Automotive Product Liability Wrongful Death Case

A Pearland, Brazoria County family brought suit against Ford Motor Company and the vehicle dealer for the death of their wife and mother.

The family was returning home from California when their Ford Explorer rolled over in West Texas. The rollover caused the death of the family mother and severe injuries to the father of the family.

The family alleged that the Ford Explorer was unstable and uncrashworthy. The defective nature of the suspension, steering and design characteristics rendered it uncontrollable. The family alleged that an electronic stability control system (ESC) was both economically and technologically feasible at the time the Explorer was manufactured that would have prevented the rollover by allowing the driver to maintain control.

The family alleged that the Ford Explorer was not crashworthy as the vehicle structure and seatbelt did not reduce or prevent their injuries. Ford, through attorneys and hired experts, claims that the vehicle is stable and crashworthy.
