Doe v. Living Earth Technology
Environmental Waste Company Agrees to Settle Case After its Disposal Truck Collided
with Elderly Couple on Interstate 10, Causing Severe Injuries
Houston, Texas – August 6, 2005
Doe v. Living Earth Technology, 164th Judicial District Court of Harris County, Texas
On
June 24, 2003, John Doe and his wife Jane, 78 years old were driving
their son home from the hospital where he had recently undergone
ophthalmologic surgery. Mrs. Doe was seated in the back seat of the
family’s Lincoln sedan.
Traffic was heavy on Interstate 10, as
it perpetually is. As Mr. Doe slowed to a stop, a Living Earth
Technology waste disposal truck violently collided with the Doe
vehicle. As the crash occurred, a 55-gallon drum of environmental waste
flew into the Doe’s trunk. The waste initially caught fire, but quickly
dissipated.
Seated in the back seat, Mrs. Doe bore the brunt
of the impact. She suffered multiple non-displaced vertebral fractures
at C3 and C4, resulting in permanent neurological loss. Fortunately,
she did not lose all sensation in her arms.
Mrs. Doe incurred
over $180,000.00 in medical expenses and will require lifelong
neurological follow-ups. Attorneys from Denena & Points, P.C. were
contacted by the family and quickly secured the evidence. After suit
was filed, the family’s attorneys were able to negotiate a confidential
settlement with Living Earth Technology.
